Welcome to Breezer! These Terms and Conditions ("Terms") govern your access to and use of the Breezer mobile application and website (together, the "Service"), operated by Breezer Ltd ("we," "us," or "our"). By accessing or using Breezer, you agree to comply with and be bound by these Terms, as well as our Privacy Policy, Acceptable Use Policy, and Refund Policy (collectively, the "Agreement").

Please read these Terms carefully. If you do not agree, you should not access or use the Service.

1. About Breezer

1.1 Purpose
Breezer is a digital service designed to help users improve personal health through the gamification of exercise. Breezer is not a substitute for professional advice or medical care.

1.2 Eligibility
You must be at least 18 years old to use Breezer. Use of the Service by anyone under 18 is strictly prohibited.

1.3 Medical Disclaimer
Breezer is not a licensed healthcare provider. Any content provided through the Service, including from community members, is for informational purposes only and should not be interpreted as medical advice.

1.4 Nutrition and Health Data
The Service may display nutritional and wellness information. Information may be user-generated or aggregated from various sources and is not guaranteed to be accurate. Use discretion when relying on this data.

2. Account Responsibilities

2.1 Registration
To access Breezer, you must create an account. You agree to provide truthful and complete information during registration and to keep your account secure.

2.2 Security
You are responsible for all activity under your account. Do not share your login credentials. Notify us immediately of unauthorized use.

2.3 Linked Accounts
You may link Breezer with third-party platforms. You are responsible for ensuring compliance with their terms.

2.4 License Grant
Subject to these Terms and any applicable fees, we grant you a limited, revocable, non-exclusive license to use Breezer during your subscription term.

3. Subscription and Billing

3.1 Subscription Periods and Pricing
Breezer may offer various plans, each with different billing cycle lengths and pricing, as disclosed at the time of purchase.

3.2 Recurring Billing
Subscriptions renew automatically at the end of each billing cycle, unless cancelled. Charges are billed to the payment method you entered at the time of purchase.

3.3 Cancellation and Refunds
You may cancel any time before your next billing cycle. Refunds are only available within 14 days of the initial charge, excluding renewals, unless otherwise required by law. More details can be found in our Refunds Policy.

3.4 Price Changes
We may change pricing or billing methods. If you do not agree, you may cancel your subscription.

4. User Content and Conduct

4.1 Your Content
You may submit text, images, or other content. You retain ownership but grant Breezer a global, royalty-free license to use, modify, and display that content in connection with the Service.

4.2 Prohibited Conduct
You agree to our Acceptable Use Policy.

5. Intellectual Property

5.1 Ownership
Breezer Ltd retains ownership of all proprietary aspects of the Service, including software, branding, and content (excluding your User Content).

5.2 Feedback
If you provide feedback, you grant Breezer the unrestricted right to use it for any purpose.

6. Disclaimers and Limitation of Liability

6.1 Disclaimer of Warranties
The Service is provided "as is." We disclaim all warranties, including merchantability, fitness for a particular purpose, and non-infringement.

6.2 Limitation of Liability
To the fullest extent allowed by law, Breezer is not liable for indirect or consequential damages. Our total liability is limited to the amount you paid in the past 12 months or £100 GBP, whichever is greater.

7. Dispute Resolution

7.1 Governing Law
These Terms are governed by the laws of England and Wales unless otherwise required by local law.

7.2 Arbitration Agreement
Any dispute arising from your use of the Service will be resolved through binding arbitration, not in court, unless you opt out within 30 days of first agreeing to these Terms. You waive your right to participate in class actions.

7.3 Exceptions
You may bring qualifying claims in small claims court. Injunctive or equitable relief may be sought in court for intellectual property violations.

8. Termination

We reserve the right to suspend or terminate your account for any reason, including violation of these Terms. You may terminate your account and delete all personally identifying information at any time through the Setting page within the app, or by contacting us.

9. Disclaimers

We may update these Terms and will notify users of significant changes. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
